On April 22, 2008, the final Renovation, Repair, and Painting (RRP) rule in Section 402 (c)(3) of the Toxics Substance Control Act (TSCA) was published in the Federal Register. The rule addresses lead-based pain hazards created by renovation, repair, and painting activities that disturb lead-based paint in housing built before 1978 and in child occupied facilities such as child care facilities and schools built before 1978. (This may be revised to 1982 in the future.) The deadline for acquiring the necessary training and setting up the certification process is April 22, 2010. |

While the new RRP rules do not apply to homeowners doing renovations
themselves, it does apply to any subcontractor hired to run new
wiring, plumb a new bathroom, install replacement windows, install a
new furnace, anyone doing projects that might disturb an area 6
square feet on the inside of a structure or 20 square feet on the
outside. |

The Ohio EPA will be checking to make sure that anybody doing these
types of jobs has at least one certified renovator on each job site.
Failure to do so can bring a stiff fine to the home owner and
possibly liens being placed on the property. Local health districts
will also be involved and it is possible that local building
departments will need to add a check box to the permitting process
for work being done on non-commercial buildings constructed prior to
1978. Commercial buildings must follow another set of rules. |
